JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-07-2024 The present writ petition has been filed seeking the following reliefs:- "1.For issuance of Mandamus directing the respondents to act upon the recommendation of Circle Officer, Goh Block, Aurangabad as contained in Letter No.-1798 dated 10.11.2023 (Annexure-3) and accordingly, ensure the construction work of Waste Processing Unit on the public land

Patna High Court CWJC No.8649 of 2024(2) dt.22-07-2024 2/3 appertaining to Mauza-Jhiktiya, Thana No.-72, Khesara No.-1325, admeasuring to 44 decimals.

ii. For direction upon the respondents to stop the construction work of Waste Processing Unit, which is being undertaken just adjacent to the place where Sun Temple, School and Pond (Pokhara) are already existing and the petitioners and local resident are utilizing the said Pond for very holy festival "Chat" since last several years.

iii. For direction upon the respondents to make an enquiry about feasibility of the project which is being undertaken on the land appertaining to MauzaGhota, Thana No.-157, Khata No.-151, Plot No.-827, admeasuring to area 0.05 decimals which is having great public importance and matter of concern for local residents including the petitioners."

At the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to approach the District Magistrate, Aurangabad for redressal of their aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioners approach the District Magistrate,

Patna High Court CWJC No.8649 of 2024(2) dt.22-07-2024 3/3 Aurangabad, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
