Petitioner apprehends his arrest in connection with Complaint Case No. 1974C of 2014 registered under Sections498A of the Indian Penal Code and section 4 of the Dowry Prohibition Act.
Vide order dated 28.06.2017 the matter was referred to the Patna High Court Mediation and Conciliation
Patna High Court Cr.Misc. No.11574 of 2017 (5) dt.31-07-2017 2/3 Centre for settlement of the dispute. Report of the Mediation Centre is on the record. Perusal of the same shows that the matter has been amicably settled.
Learned counsel for the petitioner submits that the matter has been amicably settled and petitioner is ready to keep his wife.
Learned counsel for the opposite party no. 2 submits that she has apprehension that petitioner may not keep her as agreed upon in the Mediation.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on provisional bail for a period of six months on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Bettiah, West Champaran in connection with Complaint Case No. 1974 C of 2014. The Court below is directed to monitor the case and in the event Court below is satisfied that dispute is resolved and matrimonial peace prevails in the family or the complainant is back to her matrimonial home or she is found to be unreasonable, provisional bail granted to the petitioner shall be
