2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 341, 323, 376(DA), 504, 506/34 of the Indian Penal Code and sections 4 and 6 of the POCSO Act.

3. As per the prosecution case, while the informant's daughter had gone to attend call of nature, petitioner and his two associates forcibly took her to Banswari and committed rape on her. Co-accused persons later on came to the door of the informant and abused and assaulted her with lathi, danda.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

Patna High Court CR. MISC. No.46288 of 2025(3) dt.12-09-2025 2/2 case. Police, after investigation, submitted final form but the court below, differing with the same, took cognizance of offence against the petitioner. He is in custody since 27.3.2025.

5. Learned counsel for the State opposes the prayer for bail. He submits that the victim, in her statement recorded under section 164 of the Code of Criminal Procedure, has supported the prosecution case.

6. Considering the nature of accusation, prayer for bail of the petitioner is rejected.
