JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioners and the learned APP for the State.

This is an application for grant of regular bail on behalf of the petitioners who are accused in connection with (Nawada) Nagar PS Case No. 440 of 2015 for the alleged offences under sections 399, 400, 402, 420, 467 and 468 of the Indian Penal Code which is pending in the court of learned Chief Judicial Magistrate, Nawada.

Learned counsel appearing on behalf of the petitioners, referring to the first information report, submits that nothing incriminating was recovered from their possession except two cell phones. He has further submitted that the petitioners have

Patna High Court Cr.Misc. No.46007 of 2015 (2) dt.07-10-2015 2/2 no criminal antecedent and other co-accused persons have been granted bail by this Court by order dated 30.9.2015 passed in Cr. Misc. No. 45480 of 2015.

The petitioners are in custody since 3.7.2015. Considering the submission aforesaid, this application is allowed. Let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with (Nawada) Nagar PS Case No. 440 of 2015. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
