JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the case took U turn and the investigating officer came to the conclusion that the informant was not an eye witness of the alleged occurrence. Furthermore, one Ansul Raj was arrested in connection with Motihari Town P.S.Case No. 128 of 2015 and made his confessional statement regarding his involvement in the present case disclosing the name of petitioner and some others.
Learned counsel appearing for the petitioner submits that except confessional statement of the aforesaid co-accused,
Patna High Court Cr.Misc. No.46716 of 2015 (2) dt.05-10-2015 2/2 there is nothing against the petitioner and moreover, co-accused Vijay Kumar @ Mantu Kumar@ Mantu and Sunil Kumar @ Vicky has been granted privilege of anticipatory bail by a coordinate Bench of this Court and apart from him, several other coaccused are enjoying the privilege of bail. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Town P.S.Case No. 218 of 2014.
