KUMAR ORAL ORDER 28-01-2021 This case has been brought under the heading "To Be Mentioned" at the instance of office pointing out that order dated 06.09.2018 which was pronounced on 10.09.2018, due to technical error was found blank subsequently. In view of the above order dated 06.09.2018 is quoted hereinbelow and is being pronounced today:- "Heard learned counsel for the petitioner, learned counsel for the State as well as learned counsel for the informant.

The petitioner apprehends his arrest in connection with Marauna P.S. Case No. 58 of 2016 registered for the offence punishable under Sections 341, 323, 498A, 504, 506/34 of the Indian Penal Code. Allegation against the petitioner is of not giving maintenance to the informant and her children. It has been submitted on behalf of the petitioner that petitioner is ready to keep his wife with full dignity and honour. It has been further submitted that in the FIR the date and year of marriage has not been

Patna High Court CR. MISC. No.29455 of 2017(10) dt.28-01-2021 2/2 mentioned nor the description of children has been given. Genral and omnibus allegation has been levelled against the petitioner.

Learned counsel for the Informant vehemently opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Marauna P.S. Case No. 58 of 2016 subject to the condition as laid down under Section 438(2) of the Cr.P.C. "
