The petitioner seeks bail in a case under Section 406, 409 and other sections of the Indian Penal Code. The petitioner in collusion with the Panchayat Secretary is alleged to have withdrew Rs. 1,68,000/- from the head of Indira Awas Yojna and Hand Pump Yojna.

It is submitted that money was withdrawn by the Panchayat Secretary while he was under suspension. The Panchayat Secretary, Surendra Paswan, has already been enlarged on bail vide order passed in Cr. Misc. 948 of 2015 and the case of the petitioner stands on the same footing. The petitioner is in jail since 02.06.2015.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.44589 of 2015 (2) dt.23-09-2015 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Anand Abhishek, learned Judicial Magistrate, 1st class, Darbhanga in Manigachhi P.S. Case No. 49/2010.
