The petitioner seeks pre-arrest bail in connection with Bagaha P.S. Case No. 385 of 2014 registered under Sections 406 and 420 of the Indian Penal Code. It is contended that the petitioner is neither named in the FIR nor any allegation has been made against him by the informant. However, in course of investigation, the police have gone in collusion with FIR named accused Arun Singh and attempt is being made to implicate the petitioner in the present case. Patna High Court Cr.Misc. No.2186 of 2016 (2) dt.18-01-2016 2 / 2 criminal antecedent and having got roots in the society, he is not likely to abscond or tamper with the evidence. Learned counsel for the State has opposed the application for grant of anticipatory bail.
Regard being had to the nature of the offence, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 385 of 2014 subject to the conditions as laid down under Section 438(2) Cr. P.C.
