The petitioner seeks bail in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2018 registered under Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act. It is submitted by the learned counsel for the petitioner that similarly circumstanced co-accused Sandeep Kumar, Shibu Yadav and Arvind Prasad have already been granted bail vide orders passed in Cr.Misc. No. 66682 of 2018, Cr.Misc. No. 73665 of 2018 and Cr.Misc. No. 75713 of 2018 respectively.

Regard being had to the facts and circumstances of the case, the petitioner, who is in custody since 12.04.2019, is directed to be released on bail on furnishing bail bond of

Patna High Court CR. MISC. No.33664 of 2019(2) dt.22-05-2019 2/2 Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge Excise, Biharsharif, Nalanda in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2018, subject to the conditions :

(a) that the petitioner shall attend court in accordance with the conditions of the bond executed;

(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
