The petitioner seeks bail in Mirganj P.S. Case No. 329/2018, instituted for offence under Section(s) 147, 148, 149, 341, 323, 307, 379, 354, 448 and 504 of the Indian Penal Code read with Section 302 of the Indian Penal Code. Learned counsel for petitioner has submitted that there is general and omnibus allegation against this petitioner in the written report. It is further submitted that charge has already been framed in this case.

It is alleged in the written report that on the date of occurrence petitioner along with 12 other accused persons armed with different weapons arrived at the door of informant

Patna High Court CR. MISC. No.39992 of 2019(3) dt.28-08-2019 2/2 and started abusing and assaulting him. Thereafter uncle of informant, namely, Baleshwar Choudhary, came to save him then petitioner and co-accused Brajesh Yadav and Chhotelal Yadav caused injury on his head. The accused persons also assaulted the other family members of informant. Uncle of informant subsequently died.

The co-accused, namely, Chhotelal Yadav has already been granted bail by a Co-ordinate Bench of this Court vide order dated 03.07.2019 passed in Cr. Misc. No. 38675/2019. Petitioner is in custody since 23.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gopalganj, in connection with Mirganj P.S. Case No. 329/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
