The petitioner has prayed for regular bail in a case registered for the offence punishable under section 379 of the Indian Penal Code.

According to the FIR, prosecution case relates to theft of motorcycle of the informant which is alleged to have been recovered from garage of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is further submitted vide para 7, 8 & 9 of the petition that the petitioner was a motorcycle mechanic and the said vehicle was brought in his garage by one

But Arun Kumar did not take the motorcycle back and in this way, the said motorcycle was parked in the garage of the petitioner. The petitioner has no knowledge that the said motorcycle was stolen property. It is further submitted that the petitioner has got no criminal antecedent and languishing in judicial custody since 28.2.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kaler P.S. Case No. 10 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad.
