2. Petitioners apprehend arrest in a case registered for the offence punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act and Sections 272 and 273 of the Indian Penal Code.

3. As per the prosecution case, 70 liters illicit liquor was recovered from the bank of a river.

4. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case on suspicion. No incriminating material has been recovered from the conscious possession of the petitioners and they are no way connected with the aforesaid recovery.

5. Learned counsel appearing for the State opposes the prayer for bail and submits that petitioners cannot be given privilege of bail as they have got criminal antecedent of similar nature.

6. Considering the fact that the petitioners have got criminal antecedent of similar nature, their prayer for bail is refused.
