2. The petitioner has preferred this application for grant of regular bail in connection with Dalsinghsarai P.S. case No. 473 of 2025 registered for the offences punishable under Sections 318(4), 85, 69, 126(2), 115(2), 352, 351(2), 3(5) of the B.N.S.
3. As per the prosecution case, the marriage of the informant was solemnized with one Vijay Shankar about thirteen years ago, and two children were born out of their wedlock. Since 2022, owing to a matrimonial dispute with her husband, the informant had been residing separately along with

It has further been alleged that in connection with a case filed by the informant under the Domestic Violence Act, she came into contact with the petitioner. Thereafter, they started communicating over the telephone, and the petitioner allegedly established physical relationship with the informant on the false pretext of marrying her.
4. Learned senior counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It has further been submitted that the informant was herself a married woman and her marriage was in force at the time of the alleged occurrence. It has further been submitted that in order to put pressure and force the petitioner to enter into a relationship with her the informant lodged the present case. It has also been submitted that being under emotional turmoil the informant developed friendship and love towards the petitioner and insisted him to marry her. Consequently, the petitioner's refusal to do so led to the filing of the present case. It has also been submitted that even if the allegations are accepted to be true in their entirety they would only indicate a consensual relationship between two consenting adults. It has further been submitted that the charge sheet has been filed and there is no allegation of tampering with the
Patna High Court CR. MISC. No.45317 of 2026(3) dt.08-07-2026 3/3 evidence against the petitioner. It has lastly been submitted that the petitioner has clean criminal antecedent and he is in custody since 08.12.2025.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the above facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur, in connection with Dalsinghsarai P.S. case No. 473 of 2025.
8. The application stands allowed.
