2. This is the 2nd attempt of the petitioner for regular bail in connection with Session Trial No. 1442 of 2024 arising out of Maranchi P.S. Case No. 37 of 2024 registered for the offence under Sections 363/365 of the Indian Penal Code and subsequently Section 302 of the IPC was added.

3. Earlier the bail application of the petitioner was rejected by this Court on 25.09.2025 in Cr. Misc. No. 54496 of 2024.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 03.04.2024. He further submits that in the trial, two witnesses have been examined and nothing substantial has come against the petitioner. He further submits that co-accused has also been released by the Juvenile Justice

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the materials available on record as well as the delay in the trial, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Add. Sessions Judge-VI, Barh, Patna/concerned Court below in connection with Maranchi P.S. Case No. 37 of 2024 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.

8. The certified copy of the deposition of P.W.-2 is taken on record.
