JUSTICE MADHURESH PRASAD ORAL ORDER 16-05-2018 Hared learned counsel for the petitioner and the State. The writ petition has been allowed under order dated
Patna High Court C. REV. No.61 of 2018 (4) dt.16-05-2018 29.1.2018 and the impugned order dated 30.6.2015 passed by the Disciplinary authority was quashed as being without assigning any reason. Six weeks' time had been granted to the Disciplinary authority to pass the final order in accordance with law. Learned counsel for the review petitioner submits that since the judgment in the case of Hassan Muhazid Vs. Bihar State Electricity Board, reported in 2015(4) PLJR 435 is not similarly situated, which has been relied upon in the order dated 29.1.2018, this Court should not have allowed the writ petition without giving consequential benefits.
The same cannot be the ground for review inasmuch as the petitioner has agitated the matter for which a fresh hearing would be required. As such, no case for review is made out. The review petition is dismissed.
