The petitioner apprehends his arrest in connection with Basantpur P.S. Case No. 98 of 2014, registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant by Shila Devi, Anita Devi and Babita Devi, motherin-law and sisters-in-law of the deceased due to non-fulfillment of demand of dowry by putting fire on her body. Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is brother-in-law of the deceased, sister of the informant and his name has not been disclosed in the F.I.R. but later on, police also submitted the

Patna High Court CR. MISC. No.33941 of 2019(2) dt.23-05-2019 2/2 charge sheet against father-in-law, husband and brother-in-law (petitioner) of the deceased. Moreover, while Shila Devi faced the trial through Sessions Trial No. 292 of 2014 but she has been acquitted on 07.07.2018 by the 5th Additional Sessions Judge, Siwan.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Basantpur P.S. Case No. 98 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
