Mr. Mohit Shriwastava, learned counsel for the informant and Mr. Bhanu Pratap Singh, learned APP for the State, are present.
Learned counsel for the informant submits that earlier vide order dated 22.01.2021, on the assurance given by the petitioner that he is ready to return the amount of Rs.25,17,000/- to the informant within six months, he was granted provisional bail by this Court. Thereafter vide order dated 26.10.2021, the period of provisional bail granted to the petitioner has been extended by further two months, on account of Covid Pandemic. However, on 05.04.2022, learned counsel, who was appearing on behalf of petitioner submitted that the representative of the
Patna High Court CR. MISC. No.35130 of 2020(11) dt.11-07-2022 2/2 petitioner has taken away the brief and he has made "No Objection" for appointing another Advocate to represent this case, thereafter the matter was taken up on 21.04.2022, 16.05.2022 and 27.06.2022, but none appeared on behalf of the petitioner to press this application.
Prima facie, from the record it appears that in spite of the undertaking given by the petitioner to this Court, the same has not been honoured and the petitioner is enjoying the privilege of provisional bail, as was granted to him vide order dated 22.01.2021.
Having perused the orders, let the provisional bail granted to the petitioner vide order dated 22.01.2021 is hereby cancelled and the learned court below is directed to cancel his bail bonds and take him into custody forthwith. The present application stands dismissed.
Office is directed to communicate this order to the concerned Court.
