JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 10-05-2017 At the outset, it is pointed out by the learned counsel for the Indian Oil Corporation Limited that earlier also a writ petition was filed by Barauni Refinery Petroleum Lok Majdoor Sangh through its so-called Secretary Ramsagun Tanti for the same relief and also relying upon similar annexure vide CWJC No. 580 of 2012 which was dismissed on merit vide order dated 17.07.2012.
Patna High Court CWJC No.1438 of 2016 (3) dt.10-05-2017 2/2 He has also produced a copy of the order dated 17.07.2012 passed in CWJC No. 580 of 2012. Let the same be kept on record.
Regard being had to the submissions made above, this writ application is clearly barred by principle of res judicata. Furthermore, it is fit to be dismissed on the ground of suppressing a relevant fact in the present writ application. Accordingly, the writ application is dismissed. (Ashwani Kumar Singh, J.)
