The petitioner seeks bail in Nagar P. S. Case No. 225 of 2018 instituted for the offence under Section(s) 302, 120B/34 Indian Penal Code and section 27 of the Arms Act. It is alleged in the written report that on the date of occurrence four named accused persons, namely, Murari Singh, Sanjay Singh, Ram Bharosi Singh, Chanchal Kumar surrounded Ramprit Kunwar and made firing on him, who subsequently died. It is further alleged that cause of occurrence is that petitioner along with Murari Singh and other accused persons as named had taken an amount of Rs. 15 lacs for purchase of land from the deceased but they neither gave him land nor returned money. Deceased was making demand to return the money.

Patna High Court CR. MISC. No.35440 of 2019(3) dt.19-07-2019 2/2 Learned counsel for the petitioner has submitted that instant occurrence has taken place due to aforesaid dispute of not returning the amount to the deceased.

From the written report it appears that there is specific allegation of making firing on the deceased against four accused persons as named above. There is no allegation of making firing against this petitioner.

The petitioner is in custody since 2.11.18. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Begusarai, in connection with Nagar P. S. Case No. 225 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U
