The State counsel accepts notice for respondent Nos. 1 to 6.

Short question for consideration in the present petition is whether petitioner is entitled to arrears of salary with reference to the post of Kachahari Secretary of Gram Kachahari of Sikta Panchayat.

Fifth respondent, Block Development Officer (BDO), Sikta Block, District -West Champaran is hereby directed to pass a speaking order whether petitioner is entitled to arrears of

Patna High Court CWJC No.152 of 2021(2) dt.27-10-2021 2/2 salary or not. If the petitioner is entitled to arrears of salary, the same shall be calculated and disbursed within a period of three months from the date of receipt of this order. In the event, the petitioner is not entitled, speaking order shall be passed and communicated to the petitioner. If the petitioner is entitled to arrears of salary, the same shall be disbursed within the aforesaid period, failing which, fifth respondent is liable to pay litigation cost which is quantified at Rs. 25,000/-, the same shall be paid to the petitioner.
