JUSTICE SHIVAJI PANDEY ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Kadam Kuan P.S. Case No. 264 of 2015, G.R. No. 4109 of 2015 registered for offences under Sections 363 and 366 of the Indian Penal Code.

Allegation has been made that the girl went from the house after receiving a telephonic call when she left the house the informant examined the diary, found a number of different persons and later on, she did not return that led to filing of the case. A recovery of girl was made from the house of Aarunati and from 164 statement, it appears that the girl was taken by the present petitioner and kept her in her friend's house namely Arunati and

The Counsel for the petitioner submits that there is no allegation of engaging the girl some illegal activity and the petitioner is in custody since 07.07.2015.

Looking to the facts and circumstances of the case, let the petitioner Rubi Kumari, be released on bail on her furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Patna in connection with Kadam Kuan P.S. Case No.264 of 2015, G.R. No. 4109 of 2015.
