State counsel accepts notice for the respondents. In the instant petition, petitioner has prayed for issuance of an appropriate writ/s, order/orders, direction, commanding the respondents to provide the Pay Scale of Rs. 5500-9000/- as well as to release the difference of scale of pay as the same has been recovered from salary with interest thereon or any other relief or reliefs which the petitioner is entitled to.

The petitioner's grievance is to extend pay scale of Rs. 5500-9000/- after a fixation and release of difference of salary. In this regard, petitioner is stated to have submitted a representation on 14.10.2014. There is inaction on the part of the respondent No. 3. Therefore, the respondent Nos. 3 and 4 are hereby directed to examine the petitioner's grievance whether he is entitled for the pay-scale of Rs. 55009000/- or not with reference to service record of the petitioner read with relevant pay rules or executive order. The above exercise shall be completed within a period of four months from the date of receipt of this order.

In the event of entitlement of the aforesaid pay scale at Rs. 5500-9000/- be assigned to the petitioner from the date he was eligible and further calculate difference of pay and disburse arrears of pay within a period of four months from today. With the above observations, the writ petition stands disposed of.
