JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-10-2015 Heard learned counsel, appearing on behalf of the petitioner, learned Assistant Public Prosecutor, appearing on behalf of the State, and also learned counsel, appearing on behalf of the informant, This application for grant of regular bail arises out of Sonbarsa P.S. Case No.34 of 2015, disclosing offences under Sections 304(B)/34 of the Indian Penal Code.
The petitioner is the father-in-law of the
Patna High Court Cr.Misc. No.46581 of 2015 (2) dt.14-10-2015 2/2 deceased. Learned counsel, appearing on behalf of the petitioner, contends that there is no specific allegation against this petitioner of any demand of dowry. He also submits that the petitioner is an elderly person and has remained in custody since 30.05.2015.
In view of the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sonbarsa P.S. Case No.34 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
