JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-02-2021 Heard learned counsel for the petitioner and Mr. Akhileshwar Dayal, learned A.P.P. for the State. Petitioner in the present case is seeking regular bail in connection with Sessions Trial No. 427 of 2017 arising out of Bikramganj P.S. Case No. 67 of 2017 registered for the offence under Sections 304(B), 201,34 of the Indian Penal Code. Perused the report as contained in letter no. 01 dated 02.01.2021 of the learned trial court.

Since the trial is at the fag end and it is likely to be concluded very soon, this Court is not inclined to grant privilege of bail to the petitioner. Prayer is, thus, refused. Considering the report of the learned trial court, it is expected that the trial shall be concluded within a period of four months from the date of receipt/production of a copy of this

It appears that only the informant and the I. O. of the case are required to depose, learned trial court shall take appropriate steps to ensure their appearance. In case there is any delay in appearance of the I. O., the same shall be brought to the notice of the Superintendent of Police, Rohtas who will ensure the presence of the I. O. in the learned trial court on the date fixed in the matter.
