JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bhagwanpur P.S. Case No. 187 of 2014, registered under Section 394, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. as on the basis of the written report of one Rameshwar Prasad, Bhagawanpur P.S. Case No. 187 of 2014 was instituted u/s 394, 302/34 of Arms Act and Section 27 of the Arms Act against unknown. In course of investigation, the Police got recorded the statement of accused Roji @ Rajiya Khatoon showing the involvement of the petitioner

Patna High Court Cr.Misc. No.46838 of 2015 (3) dt.12-02-2016 2/2 in the present case, except the confessional statement, there is nothing against the petitioner. Further submission is that besides the present case, petitioner is also accused in other case, in which he has been granted bail. The petitioner is in custody since 12.08.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri M.K. Srivastava, Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No. 187 of 2014. (Rajendra Kumar Mishra, J) manish/- U T
