This application for grant of regular bail arises out of Muffasil P.S. Case No. 446 of 2020 registered for the offences punishable under Sections 120 (B) and 414 of the Indian Penal Code and Section 30(a), 41(i) of the Bihar Prohibition and Excise Act, 2018.

The police are said to have recovered 1551.96 liters of illicit Indian made foreign liquor from a truck and a Bolero vehicle. No person was apprehended from the said vehicles. Names of the petitioner and others have been mentioned in the

Patna High Court CR. MISC. No.33998 of 2020(3) dt.27-01-2021 2/2 F.I.R. on the basis of information which the Police Officer, who is the informant, is said to have received from a spy/informer. Learned counsel appearing on behalf of the petitioner has argued that there is no material against the petitioner except for the said vague disclosure made by the spy. Considering the nature of allegation in the F.I.R., this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II Begusarai-cum-Special Judge, Bihar Prohibition and Excise Act in Muffasil P.S. Case No. 446 of 2020.
