2. The petitioner has preferred this application for grant of regular bail in connection with Tariyani Chapra P.S. Case No. 52 of 2024 dated 15.06.2024 registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code, under Sections 20, 22, 23, 24, 27 and 29 of the NDPS Act and Section 25(1-B)(a), 26 and 35 of Arms Act.

3. As per the prosecution case, one loaded country made katta, one screen touch mobile and 1.52 ml. Smack from the possession of the co-accused, Raju Kumar, one loaded country made pistol and 1.52 ml. smack from the possession of

Patna High Court CR. MISC. No.45746 of 2025(2) dt.15-09-2025 2/3 the co-accused Suraj Kumar, one knife and 1.52 ml. smack from the possession of the co-accused Bhola Ram and 1.52 ml. smack from the possession of the co-accused Shravan Kumar were recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that neither the petitioner was arrested from the spot nor he was seen at the place of occurrence. The apprehended person disclosed the name of the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The seized contraband is of small quantity. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 30.01.2025. The co-accused person has already been granted regular bail by this Court vide order dated 13.11.2024 passed in Cr. Misc. No. 77494 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond

Patna High Court CR. MISC. No.45746 of 2025(2) dt.15-09-2025 3/3 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Sheohar in connection with Tariyani Chapra P.S. Case No. 52 of 2024.
