JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 Petitioner seeks regular bail in connection with Bhagalpur Rail P.S. Case No.165 of 2018 registered for the offences punishable under Sections 401 & 414 of the Indian Penal Code.
Allegation as per F.I.R. against the petitioner is that petitioner and other accused persons involved in snatching the Purse inside the train. It has also been recovered from the possession of co-accused Mohd. Chand and there is recovery of two pieces of blade from the possession of the petitioner. Submission of the learned counsel for the petitioner is that the allegation is heinous but petitioner is in custody for more than 08 months and other co-accused have been granted privilege of bail by Co-ordinate Benches of this Court vide
Patna High Court CR. MISC. No.33230 of 2019(2) dt.20-05-2019 2/2 order dated 18.01.2019 passed in Criminal Misc. No.78721 of 2018 and order dated 17.01.2019 passed in Criminal Misc. No. 903 of 2019.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M. Railway, Bhagalpur, in connection with Bhagalpur Rail P.S. Case No.165 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
