JUSTICE SHIVAJI PANDEY ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner, leaned counsel for the State and learned counsel for the B.S.F.C. The Certificate Officer after consideration of the objection of the petitioner, has passed the order, thereby assessed the amount of Rs. 3,24,72,220/-, but the petitioner has not paid any of the amount.

The counsel for the petitioner submits that the petitioner is in jail-custody for last three months. Considering the facts and circumstances, let the

Patna High Court CWJC No.18320 of 2016 (2) dt.27-04-2017 2/2 petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Certificate Officer, Muzaffarpur(East) in connection with Certificate Case No. 568/2014-15, but this benefit is being granted only for the purposes of filing an appropriate appeal, subject to the condition that the petitioner would file an appropriate appeal in terms of section 60 of the P.D.R. Act. If he fails to file the appropriate appeal without depositing the amount, which has been mentioned in section 60 of the P.D.R. Act, the B.S.F.C. will be at liberty to take action in accordance with law. Accordingly, this petition is disposed of.
