JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-09-2015 Learned counsel for the petitioner is permitted to make necessary correction in Para-1 of the petition. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have opened fire causing injury on the neck of the informant but submission on behalf of the petitioner is that there is case and counter case between the parties and moreover, the alleged occurrence took place on account of land dispute and subsequently, the parties settled their dispute amicably.

It is the prosecution case itself that the alleged firing was made from a long distance as a result there of informant

Patna High Court Cr.Misc. No.45194 of 2015 (2) dt.29-09-2015 2/2 sustained only one pellet injury.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Bhojpur in connection with Tarari P.S.Case No. 41 of 2015.
