Ms. Anita Kumari Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-01-2021 Heard the learned counsel for the petitioner and the learned APP for the State, Ms. Anita Kumari Singh.

The present petition has been filed by way of second attempt at the behest of the petitioner for grant of bail inasmuch the earlier petition filed by the petitioner for grant of bail in connection with Phulwari Sharif P.S. Case No. 782 of 2019 under Sections 304B and 120B of the Indian Penal Code was rejected by a coordinate Bench of this Court vide order dated 20.01.2020 passed in Criminal Miscellaneous No. 2267 of 2020.

The petitioner is alleged to have caused death

Patna High Court CR. MISC. No.34886 of 2020(2) dt.25-01-2021 2/2 of his wife on account of non-fulfillment of the demand for dowry.

The learned counsel for the petitioner submits that the petitioner is languishing in custody since 30.11.2019, hence, a sympathetic view may be taken.

Per contra, the learned APP has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the leaned counsel for the petitioner and taking into account the materials available on record, this Court finds that there is no change in circumstance from the date the prayer of the petitioner for grant of bail was rejected till date, hence, there is no occasion to reconsider the prayer of the petitioner for grant of bail.

Accordingly, the present petition stands dismissed.
