JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 354, 379, 34 of the Indian Penal Code. It is alleged by the informant that petitioner's son Abhishek used to tease the informant. On 02.04.2015, Abhishek along with 3-4 friends came started abusing and assaulting the informant. When the family members of the informant made protest then petitioner along with son and others came and assaulted.

It is submitted by learned counsel for the petitioner that accusation of assault is by seven persons when the informant received one marginal size injury and one abrasion, simple in nature.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.2719 of 2016 (2) dt.18-01-2016 2/2 Considering the accusation not being corroborated with the medical opinion and the thrust of accusation against the son of the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
