2. The petitioner apprehends his arrest in connection with Tetarhat P.S. Case No. 32 of 2026, for an alleged offence registered under Sections 115(2), 126(2), 303(2), 74, 109(1), 329(4), 351(2), 352, 3(5) of the B.N.S.
3. As per the prosecution case which has been lodged on the basis of the written report submitted by the informant to the effect that while he was going to his field, the accused persons including the petitioner were taking measurement of the land of the informant, when the same was opposed by the informant, all the accused persons started assaulting him. When Panchanand Singh and Manoj Kumar Singh came there to save the informant, all the accused persons started assaulting him.

4. The learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. As per the F.I.R. the only allegation against this petitioner is that he assaulted Panchanand Singh on his whole body due to which he sustained injuries. However, the injuries found on the person of Panchanand Singh are found to be simple in nature by the doctor. He further submits that there is land dispute between the parties and case is still pending before the competent Revenue Court of DCLR. The petitioner has got four cases pending against him, apart from this case. In two cases, he has been acquitted and in two other cases he is on bail.
5. Per contra the learned APP for the State opposes the prayer of the bail of the petitioner and submits that the petitioner has got four criminal antecedent.

Having heard the rival submissions and after going through the records it appears that specific allegation of assault against the petitioner is upon Panchanand Singh and from perusal of the injury report, which has been annexed as Annexure-P/2 to the present petition, it would transpire that the injuries sustained by the injured Panchanand Singh is simple in

Considering the above let the petitioner above named in the event of arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of learned Additional Chief Judicial Magistrate-III, Lakhisari in connection with Tetarhat P.S. Case No. 32 of 2026, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., with further conditions:
(1) The learned Court concerned shall verify the criminal antecedent of the petitioner and in case at any stage, it is found that the petitioner has concealed his criminal antecedents, the court concerned shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above mentioned order shall not be delayed for purpose of or in the name of the verification. (Ritesh Kumar, J) vinita/- U T
