JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code. The prosecution case is that the petitioners came and demanded liquor from the informant's shop after closer of the shop of the informant and when the informant denied then accused persons made assault to the informant and wrapped towel around the neck to strangulate him. It is further alleged that petitioner No. 1 snatched gold chain and cash of Rs. 9000/- of the informant.

It is submitted by learned counsel for the petitioners that for a petty dispute the accusation has been levelled and subsequent to lodging of the First Information Report, Complaint Case No. C-I-509 of 2015 was filed by one

Patna High Court Cr.Misc. No.6335 of 2016 (2) dt.09-02-2016 2/2 Bibi Rashida Khatoon wife of petitioner No. 1 Rahmat Ansari levelling accusation under Sections 376/511 of the Indian Penal Code.

Considering the nature of accusation, let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Sursand P.S. Case No. 273 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi.

With the observations above, the application stands disposed off.
