Let the same be done during the course of the day. Heard the learned counsel for the parties.

The present petition is a second attempt at the behest of the petitioner herein for grant of regular bail in connection with Laxmipur P.S. Case No. 302 of 2017 registered for the offence under Sections 397, 395/34 of the Indian Penal Code inasmuch as the earlier prayer of the petitioner for grant of regular bail was rejected by an order dated 10.01.2019 passed in Criminal Misc. No. 69315 of 2018.

The learned counsel for the petitioner submits that the petitioner was granted liberty to renew prayer for bail after framing of the charges and in the connected case i.e. Laxmipur P.S. Case No. 302 of 2017, charges have been framed on 02.04.2019, as is also apparent from a report sent by the learned District & Sessions Judge-III, Jamui dated 29th July, 2019.

No.44358 of 2019(3) dt.28-08-2019 2/2 The learned counsel for the petitioner has further submitted that the petitioner has not committed any offence rather, he has not been put on Test Identification Parade and the name of the petitioner has transpired on his own confessional statement and moreover the petitioner is in custody since 24.04.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Jamui in connection with Laxmipur P.S. Case No. 302/2017, S. Tr. No. 89/2019.

It is further directed that the petitioner shall appear before the learned Trial Court on each and every date so fixed by the learned Trial Court and in the event of any default on the part of the petitioner, the present privilege of bail being extended to the petitioner shall stand withdrawn automatically and the petitioner shall be taken in custody forthwith.
