1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Bajpatti P.S. Case no. 220 of 2024 registered under sections 331(4), 305(a) of the Bharatiya Nyay Sanhita, 2023.
3. As per the prosecution case, the informant states that on returning home it transpired that a theft had been committed and various articles including clothes, ornaments etc. as described in the FIR had been stolen. The informant further states that on enquiry it transpired that the petitioner along with his associates were involved in the theft.
4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Contrary to the finding recorded in the investigation in the
Patna High Court CR. MISC. No.35209 of 2025(2) dt.11-06-2025 2/2 case diary as has been mentioned in the order of the learned Court below, it is submitted that no incriminating article has been recovered from the petitioner's possession. The petitioner is in custody since 12.10.2024 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., his being in custody since 12.10.2024 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bajpatti P.S. Case no. 220 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Sitamarhi.
