JUSTICE RAJESH KUMAR VERMA ORAL ORDER 18-09-2024 Heard Mr. Niranjan Parihar, learned counsel for the petitioner, Mr. Satish Chandra, learned counsel appearing on behalf of the Informant and Mr. Kumar Veerendra Narayan, learned APP for the State.
2. Petitioner seeks bail, who is in custody since 10.12.2023, in connection with Beur P.S. Case No. 814 of 2023, F.I.R. dated 08.12.2023 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The F.I.R. of the occurrence of murder is against unknown.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the
Patna High Court CR. MISC. No.40378 of 2024(3) dt.18-09-2024 2/3 present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offence as alleged in the F.I.R. He further submits that the informant is not an eye witness of the alleged occurrence and except the confessional statement of co-accused person, no other material has come during investigation to suggest the involvement of the petitioner in the present occurrence.

Learned counsel for the Informant as well as learned APP for the State, on the other hand, on the basis of material available on record as well as case diary, vehemently opposed the prayer for bail of the petitioner and submits that it has come during investigation that the petitioner was involved in the present crime in question and the weapon which was used in the present crime in question has been recovered and apart from that some clothes were also recovered from the house of the petitioner which was used by other co-accused person in the present crime in question. He further submits that the petitioner has also confessed his guilt in the present crime before the police and the petitioner carries four more cases other than the present one.
6. Considering the aforesaid facts, I am not inclined
Patna High Court CR. MISC. No.40378 of 2024(3) dt.18-09-2024 3/3 to enlarge the petitioner on bail in connection with Beur P.S. Case No. 814 of 2023 pending in the Court of learned Judicial Magistrate 1st Class, Patna.
