The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Musrigharai P.S. Case no. 152 of 2021 instituted for the offence under Sections 304B/34 of the Indian Penal Code. It is a case of dowry death of the informant's daughter due to non-fulfillment of dowry demand of a motorcycle and cash of Rs. 2 lakh.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. She has got no criminal antecedent. Petitioner is mother-in-law of the deceased due to which she has falsely been made accused in this present case. She was living separately and

Patna High Court CR. MISC. No.36342 of 2022(2) dt.29-11-2022 2/2 has no concern with the mess and business of the deceased. It is further submitted that the specific allegation of demanding dowry is against the husband of the deceased who is already in judicial custody.

Learned APP appearing for the state has opposed the prayer of anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Musrigharari P.S. Case no. 152 of 2021, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Samastipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
