JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-10-2015 Heard learned senior counsel, appearing on behalf of the petitioner and learned Assistant Public Prosecutor, appearing on behalf of the State. This application for grant of regular bail arises out of Turkaulia P.S. Case No.623 of 2015, disclosing offences under Sections 20 & 22 of Narcotic and Psychotropic Substances Act.

As per the prosecution case, 1 kg. of Ganja is said to have been recovered from the possession of the petitioner. Learned senior counsel, appearing on behalf of the petitioner, has submitted that the petitioner is nearly 75 years of age and the quantity of Ganja, said to have been recovered from his possession, is much less than the

Patna High Court Cr.Misc. No.46605 of 2015 (2) dt.15-10-2015 2/2 commercial quantity. He has also submitted that the petitioner has no criminal antecedent and there is no likelihood of him tampering with the evidence. He has further submitted that petitioner is in custody since 20.08.2015.

In view of the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Krishna Kant Tripathi, learned Sessions Judge/Special Judge, East Champaran, Motihari, in connection with NDPS Case No. 043 of 2015, arising out of Turkaulia P.S. Case No.623 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
