This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Aurai PS Case No. 39 of 2015 for the alleged offences under Sections 302, 34 and 201 of the Indian Penal Code which is pending in the court of learned Judicial Magistrate 1st Class, Muzaffarpur.
Learned counsel for the petitioner has submitted that he has been implicated along with other co-accused persons on the ground that he was last seen with the deceased. He contends that similarly circumstanced co-accused, namely, Dilip Rai and Nand Kishore Rai have been granted regular bail by this Court vide order dated 27.8.2015 passed in Cr. Misc. No.36549 of 2015.
Patna High Court Cr.Misc. No.45995 of 2015 (2) dt.07-10-2015 2/2 He further submits that the petitioner has no criminal antecedent. In view of the submission as above, this application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Jawed Alam, Judicial Magistrate 1st Class, Muzaffarpur, in connection with Aurai PS Case No. 39 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
