JUSTICE RAVI RANJAN ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and the State. The records of Encroachment Case No. 2 of 2011-12 has been produced. After going through the records it appears to me that callous and negligent approach has been adopted by the Anchala Adhikari in the concerned matter. A matter which was initiated on 2.9.2011 could not be brought to its logical conclusion till date and the ordersheet shows that for this reason or that reason the matter was being deferred and despite issuance of notice under Section 3 of the Bihar Public Land Encroachment
Patna High Court CWJC No.704 of 2016 (3) dt.18-03-2016 2/2 Act, 1956 nothing has been done till date. However, the Circle Officer, who is present in person, has submitted that he would bring the matter to its logical conclusion within three months after granting reasonable opportunity to all the concerned including the encroachers.
In above view of the matter, this writ application is being disposed of with, without going in to the merit of the case, with a direction to the Circle Officer, Vidyapati Nagar to bring the matter to its logical conclusion within a period of three months. However, he should be very cautious in future in dealing with such issues.
The personal appearance of Circle Officer, Vidyapati Nagar is dispensed with.
