2. The petitioners apprehend their arrest in connection with Bidupur P.S. Case No. 709 of 2024 registered for the offences punishable under Sections 318(2), 319(2), 318(4), 338, 336(3) and 340(1) of the BNS, 2023.

3. The petitioners, after filing a forged challan in the Court of the CJM, Hajipur at Vaishali, became successful in release of their tractor.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They had given the amount for the challan to Samir Kumar and Guddu Paswan in cash, but they did

Patna High Court CR. MISC. No.34415 of 2025(4) dt.04-11-2025 2/2 not deposit the amount. Vipat Kumari, the wife of petitioner no. 2, has lodged a complaint case against Samir Kumar and Guddu Paswan.

5. Learned counsel could not satisfactorily reply to the query of the Court as to why, the wife of petitioner no. 2 and not the petitioners, filed the complaint case.

6. The petitioners are directed to surrender in the court below and seek regular bail. If the petitioners do so, the same shall be disposed of on its own merit without being prejudiced by this order.
