This application for anticipatory bail arises out of Mirganj P.S. Case N0. 49 of 2018, disclosing offences under Sections 379,411,420 of the Indian Penal Code. On the allegation of fraudulent withdrawal of money from the ATM, one Aman Kumar Yadav, the co-accused was arrested. He had disclosed the petitioner's name as his accomplice.
Learned counsel for the petitioner contends that said Aman Kumar Yadav has been allowed regular bail. He has also submitted that one co-accused Rajesh Kumar Singh has also been allowed anticipatory bail by this Court by order dated 01.10.2018, passed in Cr. Misc. No. 60737 of 2018.
Considering the above, this application is allowed.

No.34594 of 2019(3) dt.17-08-2019 2/2 Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Purnea in Mirganj P.S. Case No. 49 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
