The petitioner is languishing in custody since 24.03.2019 in a case registered for the offence punishable under Section 420 of the IPC.

It is alleged that the petitioner realized Rs. 75,000/- from the informant on pretext of providing employment to him, but neither the employment was provided, nor has the money been returned.

It is submitted by learned counsel for the petitioner that there is no proof with regard to payment made by the informant to the petitioner. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Patna High Court CR. MISC. No.34681 of 2019(2) dt.29-05-2019 2/2 Learned APP submits that the petitioner is named in the FIR with specific accusation.

Considering the fact that the informant tried to get employment through illegal means and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Khagaria in connection with Gogari P.S. Case No. 67 of 2013.
