1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Bhore P.S. Case no.320 of 2024 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per the prosecution case, on information having been received a raid was conducted by the police personnel. It is stated that seeing the police, two accused persons managed to flee away taking benefit of darkness. The local chaukidar disclosed the petitioner to be amongst the persons who had managed to flee away. A total of 207 litres of country liquor was recovered from near the canal.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession. He has been falsely implicated in the case because
Patna High Court CR. MISC. No.35373 of 2025(2) dt.11-06-2025 2/2 of his antecedent. He has no concern with the seized liquor and undertakes to cooperate in the investigation/trial.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the petitioner not having been arrested at the spot and his being in custody since 24.3.2025, the petitioner is directed to be enlarged on bail in connection with Bhore P.S. Case no.320 of 2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XIII-cumSpecial Judge Excise-I, Gopalganj.
