Counsel for the petitioner submits that on previous occasion he has confined his prayer to only relief No. (iii) to directed the respondents to grant necessary relaxation in the eligibility criteria in regard to career progression at DGT instructor with further direction to the respondent state to restore to pay parity and to initial grate pay ought to have been fixed at Rs. 4,600/- as as been done in regard to the post of Vice

Learned counsel for the petitioner submits that he has already filed representation vide letter no. 126/2016-18 dated 18.12.2016 before the Principal Secretary, Department of Labour Resources Government of Bihar for consideration of his grievances. He submits that on the said matter no decision has been taken by the Principle Secretary yet.

4. Counsel for the State submits that petitioner is not entitled for any relief as in the matter of vice principle, the decision has been taken at the level of State after due deliberation.

5. It transpires to this Court that representation of the petitioner is pending on which no decision has been taken till date.

6. Considering the aforesaid fact, the present writ petition is disposed of directing the petitioner to file a fresh representation within 30 days from today before Respondent No. 2. Petitioner is also directed to indicate in the representation that what was the position at that time and what is of now. Respondent No. 2 is directed to pass reasoned and speaking order on the representation of the petitioner within 90 days thereafter.

7. It is made clear that the petitioner is at liberty to raise all the points which he has raised in the present writ petition before the Respondent No. 2 (Dr. Anshuman, J) Sunnykr/- U
