JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
The present writ petition has been filed for setting aside the order dated 13.11.2019 passed by the Sub-Divisional Officer, Jagdishpur, Bhojpur at Ara, whereby and whereunder the PDS license of the petitioner bearing License No.110/2016 has been cancelled.
At the outset, the learned counsel for the petitioner seeks liberty to file an appeal under Rule 32(3) of the Bihar Targeted PDS (Control) Order, 2016 before the District
Patna High Court CWJC No.276 of 2021(2) dt.06-09-2021 2/2 Magistrate, Bhojpur at Ara. Liberty so sought is granted. Accordingly, the present writ petition stands disposed off with liberty to the petitioner to file appropriate appeal against the order dated 13.11.2019 passed by the Sub-Divisional Officer, Bhojpur at Ara and in case such an appeal is filed within two weeks from today, the appellate authority shall examine the same on merits and dispose of the same, in accordance with law, by a reasoned and speaking order within a period of eight weeks thereafter.
The writ petition stands disposed off on the aforesaid terms.
