Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The petitioner is in judicial custody in connection with S.Tr. No.434 of 2022 arising out of Kotwa P.S. Case No.342 of 2019 instituted under Sections 304(B)/201/120(B)/34 of the Indian Penal Code.
As per the prosecution story, the petitioner was married to the victim lady in 2016 and on 26.11.2019, the informant received a call from the petitioner that his sister is no more. When he reached there the body was already cremated. The matter is of 2019, the petitioner himself informed the informant about the death of his wife, still he chose 2021 to finally walk into judicial custody. Taking into account the
Patna High Court CR. MISC. No.36891 of 2022(2) dt.26-09-2022 2/2 aforesaid fact, this Court is not inclined to grant him privilege of bail.
As informed by the learned counsel for the petitioner the Trial is on and as such the Trial court is directed to expedite the trial and conclude it within a period of one year. (Rajiv Roy, J) Prakash Narayan /- U T
