JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner being husband of the complainant is languishing in jail custody since 02.07.2015 in a case registered under section 498A, 341,323 and 406 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
The contention on behalf of the petitioner is that the complainant herself does not want to lead her conjugal life with the petitioner and so far as petitioner is concerned, he made several attempts to pacify the dispute but all went in vain. To fortify the aforesaid contention, learned counsel for the petitioner
Patna High Court Cr.Misc. No.46948 of 2015 (2) dt.07-10-2015 2/2 drew my attention towards Annexure-2 to this petition said to be given by the petitioner before religious court and also towards the impugned order to show that in spite of issuance of notice the complainant did not appear before the court below for reconciliation of the dispute.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Patna in connection with Complaint Case No. 2983 C of 2013.
