The petitioner who is in custody since 18.06.2018 has filed the instant application for grant of bail in connection with Hussainganj P.S. Case No. 356 of 2017 registered for the offence punishable under sections 302 and 120B of the Indian Penal Code and section 27 of the Arms Act.

As per the allegation in the FIR, the informant received information on telephone about injury of his father. On reaching the place of occurrence, he found the father lying in injured condition. He rushed to the hospital with his father but on arrival his father declared dead.

It is submitted by learned counsel for the petitioner that the F.I.R were registered against unknown persons and the

Patna High Court CR. MISC. No.34505 of 2019(4) dt.18-09-2019 2/2 name of the petitioner has transpired in course of investigation in the confession of co-accused with the role of giving orders along with one Chandan Singh. It is further submitted that the petitioner is in custody since 18.06.2018.

The application for bail was opposed by learned APP for the State stating that from perusal of the antecedent report the petitioner appears to be a veteran criminal. Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation as also the fact that the petitioner is in custody since 18.06.2018, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S.
